1. INTRODUCTION AND DEFINITIONS

1.1 Parties

These Terms of Service ("Agreement") are entered into between ShotSMS ("Platform", "We", "Company") and any natural or legal person who accesses and/or uses the Platform ("User", "You").

1.2 Definitions

• Platform: The website and mobile applications accessible via www.shotsms.com domain.
• Service: Virtual phone number rental and SMS verification services.
• Virtual Number: Temporarily available phone numbers obtained from third-party providers.
• Balance: Credit amount in the User's account that can be used to purchase services.
• SMS Verification: The process of receiving one-time codes for account verification on various online platforms.

2. ACCEPTANCE OF TERMS

2.1 Acceptance Conditions

By accessing the Platform, creating an account, or using our services, you represent that you have read, understood, and agree to be bound by all terms and conditions of this Agreement.

2.2 Age Requirement

You must be at least 18 years old to use the Platform. If you are under 18, you may not use the Platform.

2.3 Capacity

By using our services, you represent that you have the legal capacity to enter into binding contracts and that you are not a prohibited user.

3. SERVICE DESCRIPTION

3.1 Services Offered

ShotSMS provides users with the following services:

• Temporary virtual phone number rental from various countries
• Receiving SMS verification codes
• Online account verification support

3.2 Third-Party Providers

The Platform obtains virtual number services through third-party providers. Therefore:

• Number availability may vary.
• Numbers for certain services may be restricted.
• Technical issues from third-party providers may affect the service.

3.3 Service Guarantee

The Platform provides services on an "as-is" basis. We do not guarantee successful SMS reception. In cases where SMS cannot be received, the paid amount will be refunded or added to the balance.

4. PROHIBITED USES

4.1 Strictly Prohibited Uses

Using the Platform for the following purposes is strictly prohibited and will result in immediate account closure:

• Fraud: Creating fake identities, financial fraud, identity theft
• Illegal Activities: Money laundering, terrorism financing, drug trafficking
• Spam and Abuse: Mass fake account creation, spam campaigns, bot networks
• Banking/Financial Services: Bank account, credit card, payment system verification
• Government Services: Government portals, tax systems, official institution accounts
• Fake Identity: Impersonating another person, creating fake profiles
• Harassment and Bullying: Harassing, threatening, or bullying individuals

4.2 Restricted Services

The Platform has blacklisted certain services in accordance with third-party provider policies. Numbers are not sold for blacklisted services.

4.3 User Responsibility

You are fully responsible for how you use the purchased numbers. The Platform accepts no responsibility for users' illegal activities.

5. ACCOUNT AND SECURITY

5.1 Account Creation

You must create an account with a valid email address to use our services.

5.2 Account Security

You are responsible for the security of your account:

• Use a strong and unique password.
• Do not share your password with anyone.
• Notify us immediately if you detect unauthorized access.

5.3 Account Suspension

We may suspend or permanently close your account without prior notice in the following cases:

• Violation of agreement terms
• Suspicion of illegal activity
• Providing false or misleading information
• Payment fraud

6. PAYMENT AND REFUND

6.1 Balance Loading

You must load balance to your account to use our services. Accepted payment methods are listed on the Platform.

6.2 Pricing

Prices vary by country, operator, and service. Current prices are displayed on the Platform.

6.3 Refund Policy

• When SMS Not Received: If SMS cannot be received for the purchased number, the paid amount is automatically refunded to your balance.
• Balance Refund: Loaded balances are non-refundable. You can only use your balance for Platform services.
• Exceptional Cases: Evaluation will be made for Platform-related technical issues.

7. INTELLECTUAL PROPERTY

7.1 Platform Rights

The ShotSMS name, logo, design, software, and all content belong to the Platform and are protected by intellectual property rights.

7.2 Usage License

You are granted a limited, non-exclusive, non-transferable license to use the Platform only for personal, non-commercial purposes.

7.3 Prohibitions

• Reverse engineering the Platform's source code
• Copying or distributing Platform content
• Using automated data collection tools

8. DISCLAIMER AND LIMITATIONS

8.1 Service Guarantee Disclaimer

The Platform does not guarantee that services will be uninterrupted, error-free, or secure. Services are provided "as is" and "as available."

8.2 Limitation of Liability

To the maximum extent permitted by law, ShotSMS shall not be liable for:

• Indirect, incidental, special, or punitive damages
• Loss of profits, business, or data
• Damages arising from third-party actions
• Consequences of user's illegal use

8.3 Maximum Liability

In any case, the Platform's total liability shall not exceed the amount you paid for the transaction in question.

9. INDEMNIFICATION

You agree to indemnify ShotSMS, its directors, employees, and business partners against all claims, damages, losses, and expenses arising from:

• Your contract violations
• Your illegal uses
• Violation of third-party rights
• Your false or misleading statements

10. AGREEMENT MODIFICATIONS

The Platform reserves the right to modify this Agreement at any time. Changes take effect on the date they are published on the Platform. Continued use of the Platform means you accept the updated terms.

11. TERMINATION

11.1 By User

You may close your account at any time. Remaining balance will not be refunded when the account is closed.

11.2 By Platform

The Platform may terminate your services for any reason or without reason, with or without prior notice.

12. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement is subject to the laws of the Republic of Turkey. Istanbul Courts and Execution Offices are authorized for disputes arising from the Agreement.

14. OTHER PROVISIONS

14.1 Severability

If any provision of the Agreement is found invalid or unenforceable, it shall not affect the validity of other provisions.

Failure by the Platform to exercise any right does not constitute a waiver of that right.

14.3 Entirety

This Agreement constitutes the entire agreement between the parties and supersedes all prior written or oral agreements.
